Keyword searching has long been a way to handle the large amount of data requiring review by litigators.
There really was no other way to review and produce the vast amount of data from your own client and from
opposing counsel. Recent software programs are now offering alternatives to keyword lists, and generating
some buzz about how defensible those lists really are.
Over-inclusive, under-inclusive? One costs
your client potentially hundreds of thousands of dollars, while one could cost your client the case through
inadvertent withholding of evidence. You need a new way to manage the data and ensure you look at the
appropriate documents.
Boston Litigation Solutions offers a software solution called Relevance. It
displays documents to the attorney on the case and builds a relevance score for every other document, based
on their answers. Numerous factors go into determining the relevance score, including document type, words
and phrases present in the document, author, and mentioned names. After the software feels stable in determining
a relevance score, usually after 1,500 to 2,000 documents, it builds a graphical chart which displays the
results. You can choose to remove the documents it deemed irrelevant, or simply use the software to prioritize
your review team. Sorting the documents according to their relevance score allows the important documents to
be analyzed at the beginning of the case and enables your team to make appropriate case closure decisions.
